A family member is returning to the UK after over 25 years of working and traveling overseas

They now plan to work 7 months in UK & 5 months overseas

They have been offered employment for the period while they are back in the UK

The Person employing them wishes to put them on the books for this period in UK

The family member will be staying with family on this visit to the UK ,

Anyone any experience on this or thoughts on how to progress it and deal with it.

Would their NI number be enough to get them started ?

They are NOT looking to scam or avoid paying the necessary taxes etc while being back in the UK

the EU believe it a good use of money to move offices every month...remain remain remain.....so one move a year doesn't seem so harsh...

To employ someone in the UK you have to jump through a few hoops and confirm the individual's right to work in the UK...which makes a mockery of the freedom of movement of people, but hey ho...you ought to check this as a minimum...

So this family member has an NI number. Are they a British citizen? If so then no issue at all.

As an employer, the first thing you should do with a new employee is confirm their right to work in the UK. This obviously gets more complicated for non-British EU passport holders post Brexit. Not so much for people who are already here, but could be more difficult for new arrivals.

If the family member doesn't have an automatic right to work here then they could apply for a work permit either in their own right or with the employer as a sponsor. These come with lots of hurdles, including expected salary from the sponsoring employer.

The family member is British

born in UK left over 25 years ago

has both British & Australian citizenship ,also kept his British passport renewed

for the last 25+ years has lived and worked overseas

OK, if British passport and an NI number then no problem at all for him working in the UK again.

He'll probably start on an emergency tax code and end up paying tax at a higher rate than necessary, but that should be easy to fix once he starts working full time. He will end up overpaying tax because PAYE will work on the basis that he is working for the full tax year, but it should be relatively easy to get a refund.

Agreed - should be no problem. NI number is biggest hurdle even if a British passport holder (some of us didn't grow up here but have the right passport).

Key for working between countries is keeping a track of your whereabouts as this will affect domicile status. However they will have to declare domicile status somewhere. This is where tax advise may be useful.

But as for getting a job and starting working the UK, there should be no blockers.

thanks guys crisis semi over

found a very old P45 at parents house and turns out still had a bank account left open from early 90,s

I tried contacting tax office prior to this

a complete waste of time ,WTF do these people actually do

If the account hasn't been used since the 90s then it'll almost certainly have been made dormant by the bank. Not too difficult to get it reactivated, but there will be a process and it might take a week or so.

I don't know about the EU, but most of the more competent HMRC staff that I've come across seem to end up working for a Big 4 firm.
